David A. Einhorn was born in Brooklyn, New York on December 11, 1961. He was admitted to the New York Bar in 1987; the District of Columbia Bar in 1988; and subsequently to the U.S. District Courts, Southern and Eastern Districts of New York; and to the Court of Appeals for the Federal Circuit. He graduated Phi Beta Kappa and was a Harlan Fiske Stone Scholar. While attending Columbia Law School, he was president of the Columbia Society of Law & Technology. He was also the recipient of a national prize in the Nathan Burkan Copyright Essay Competition. Mr. Einhorn is an established author in the field of Computer Law. He is also the co-author of several articles in the fields of intellectual property, insurance coverage, and environmental law.

Mr. Einhorn has served as intellectual property consultant to the National Economic Council. He is also very active in bar associations. Mr. Einhorn was chairman of the American Bar Association subcommittee on software patents from 1988 to 1991, chairman of the American Bar Association subcommittee on software licensing from 1991 to 1995 and is currently chairman of the American Bar Association subcommittee on software copyrights. He has also served as chairman of the Electronic Information Committee of the International Trademark Association.
